Drainage deficiencies
Water that has nowhere to go is one of the most common site conditions behind a construction defect claim.
A drainage deficiency is a site condition, typically improper grading or paving, that lets water pool against a building instead of draining away from it. Where a jurisdiction has adopted the International Residential Code, that code requires lots to slope away from foundation walls and paved surfaces near the foundation to shed water outward.
What a drainage deficiency looks like
Drainage deficiencies show up as water that has nowhere to go: standing puddles at a foundation corner after rain, soil that stays wet against a wall for days after a storm, or a walkway that pitches toward the building instead of away from it. The underlying problem is almost always the shape of the ground and paved surfaces around the building, not a single broken pipe or gutter.
Whether a specific site meets a legal drainage standard depends on which building code your jurisdiction adopted, which edition, and when the property was permitted. Check with your local building department before assuming a standard applies.
What the code requires, where it applies
Where a jurisdiction has adopted the International Residential Code, section R401.3 sets a specific, numeric grading standard rather than a vague "drain the water away" instruction.
"Lots shall be graded to drain surface water away from foundation walls. The grade shall fall not fewer than 6 inches (152 mm) within the first 10 feet (3048 mm)."

The same section covers paved surfaces near the foundation separately from bare ground.

The code also addresses grading while a project is still under construction, requiring that temporary grading not create flooding or damage to a neighboring property.
Local amendments can change these numbers, and not every jurisdiction has adopted this edition of the code. Confirm which code and edition applied when your building was permitted before citing a specific figure.
Confirming it is a real defect
Standing water is a symptom, not a diagnosis. A qualified investigator typically starts with the plans and grading records, then does a site visit to see how water actually moves during or after rain, comparing what was built against what the drawings called for. Forensic engineering practice generally breaks this into stages: site inspection and documentation, evidence collection such as soil or drainage testing, analysis to find the root cause, and a written report.
A board's job is not to make that call itself. It is to notice the pattern (water pooling in the same spot after every rain, soil that never dries out) and bring in someone qualified to confirm whether grading is out of standard before anyone starts regrading, patching, or repaving on their own.
