Learn which gates are legal safety barriers, and why testing the latch matters as much as fixing the hinge.

A gate that guards a pool, a retention pond, or another hazard is a safety barrier, not decoration. Pool gates specifically must self-close and self-latch under the code your community's pool code has adopted. Test that mechanism on every inspection, not just how the gate looks: a fence can be completely intact while a stuck or propped-open latch defeats the entire barrier.

A pool gate can look fine and still fail its job

Sources describing the International Swimming Pool and Spa Code report that pool barriers must be at least 48 inches above grade, with no opening large enough to admit a 4 inch sphere, and gates that self-close, self-latch, and swing away from the pool. The exact height, clearance, and latch requirements depend on which pool code your jurisdiction has adopted and any local amendments; confirm the current figures with your pool operator or building department.

The point for a board walk-through is simple: don't just look at the fence. Push the gate open and let go. If it doesn't swing shut and latch on its own, the barrier has failed even though nothing looks broken.

Not every hazard-guarding gate is a pool gate

The same logic applies to gates around other hazards, including locked access to pump rooms and equipment at a retention or detention pond. EPA guidance on stormwater facilities calls for a documented operation and maintenance plan that identifies who is responsible for the site and how often it gets inspected, and a privately owned pond is typically the association's responsibility to maintain.

Whether a specific pond or detention structure legally counts as a regulated dam, and what inspection interval applies to its gates and structures, is a state-by-state question. Some HOA ponds are regulated dams and some are not; the only way to know is to ask your state's dam safety office.

Entry and vehicle gates are mechanical equipment, not fixtures

An automatic vehicle gate has motors, sensors, and moving parts that can injure someone if a component fails. No single nationwide standard sets an inspection interval for these, so the practical rule is to follow the manufacturer's recommended service schedule for your specific gate operator, and to log every inspection the same way you log any other work order.

If a gate sticks, reverses unpredictably, or fails to stop on contact, treat it as out of service immediately. Waiting for a full failure, or bundling the fix into next year's reserve study review, turns a mechanical warning sign into an injury risk.
